Our platform, hereinafter Propertymanagementgutierrezgroup.com.co, has the purpose of promoting and marketing real estate for short and long-term leases, and the management and operation of our own and/or third-parties’ real estate and facilities that offer the service of tourist housing.

Our Site is controlled and operated directly by us. If you enter Propertymanagementgutierrezgroup.com.co from other countries, you will do so on your own initiative and it is, therefore, your responsibility to abide by our national legislation.

By entering the Site you acknowledge having read and understood these Terms and Conditions, hereinafter (“Terms and Conditions”), and, therefore, you accept the obligation to respect its content, privacy policy, cookies policy, legal notices and all disclaimer clauses established here.

These Terms and Conditions are subject to change without prior notice, at any time, and from the modification date of these Terms and Conditions, all leasing operations, or applications for management of your property will be governed by that new document.

Collection of personal data

In the process of applying for a property lease or requesting real estate management, we will collect your personal data and process it in accordance with our Personal Data Treatment Policy, published on our Site. Therefore, you are committed to provide us with correct and true personal information for the effective handoff of the properties.

Likewise, our allies such as the main OTA, payment gateways or any other company with which we have a future contract, will request your credit card information, your personal data such as billing address, telephone, and email.

When accessing those websites or any other payment gateway that we have in Propertymanagementgutierrezgroup.com.co, you must accept the terms and conditions that each of them has made available to continue with the payment of the service provided. Consequently, the data you provide will be the payment gateway’s responsibility, or its contractors and/or other companies that this company hires for personal data treatment.

Your responsibilities

You must promptly notify your bank about the loss or theft of your credit card and/or other tools provided for the payment of the service, including debit cards, PIN Numbers, etc., for such tools to be disabled.

Marketed properties, their availability, and restrictions

Conditions and information for payment

The price that you will pay for the tourist housing rental will be the price effective on the Site at the time the application is made.

By booking a property, you agree to pay all charges for your reservation, including the rental price, applicable fees such as our company’s service fee, taxes, and other items identified during the checkout process. You also agree that our company may charge and collect any security deposit identified during the booking and payment process.

When you receive the confirmation of the reservation, you will directly enter a tourist housing rental contract with our company, regulated by legislation which is current and applicable to the matter.

Before our acceptance, you must select the terms and payment conditions according to the payment means that are provided on our Site.

Propertymanagementgutierrezgroup.com.co makes available for you a secure connection system to carry out the transactions performed there. However, in no case will it be responsible for errors that arise in the communications of banking or credit entities, nor for damages caused by an action or omission on the part of said entities.

As soon as we verify the payment, we will proceed to accept the rental application. However, even when the payment has been verified, we reserve the right to deny the lease or partially accept it, in which case we will only be obliged to return to you, without any interest or profit, the amount paid for the denied application or the percentage corresponding to the unapproved part of a partially accepted application.

CANCELLATIONS, REFUNDS AND BOOKING MODIFICATIONS

Cancellations and Refunds

If you decide to cancel a reservation, the amount to be reimbursed will be determined based on the following cancellation policy applicable to each reservation.

  1. You will be entitled to a full refund if you cancel within forty-eight (48) hours after the reservation is confirmed, and if there are at least fourteen (14) days until your arrival.
  • If you cancel at least seven (7) days before your arrival, you will be entitled to a refund of fifty percent (50%) of the value of the reservation.
  • In the event that you cancel the reservation within seven (7) days before your arrival, we will not be able to refund you.

Propertymanagementgutierrezgroup.com.co will not be liable for any delay or failure resulting from causes beyond our reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, restraints, acts of civil or military authorities, fires, floods, accidents, pandemics, epidemics, or diseases, strikes or a shortage of transportation facilities, fuel, energy, manpower or materials.

Booking Modifications

You are the only one responsible for any modification to the booking of the property to be rented, therefore, you agree to pay any additional amount, commission or tax associated with such modification if it is applicable and as long as it is not attributable to Propertymanagementgutierrezgroup.com.co

Right of withdrawal

In accordance with the Consumer Statute, you can exercise your right of withdrawal within (5) five business days after receipt of the rental application, if its nature, time between the reservation and arrival at the property allow it.

MISCELLANEOUS

Disclaimer and Warranties

The properties marketed on our Site are provided on an “as is” basis, without any warranties of any kind, either express or implied, including, but not limited to, adequation warranties for a particular purpose which don’t affect or violate the rights of third parties.

Propertymanagementgutierrezgroup.com.co advices that the information contained therein may contain errors or inaccuracies and may not be complete or up to date. Therefore, we reserve the right to correct any error, omission, or inaccuracy, to change or update it at any time and without prior notice.

We do not guarantee that use of the Site will be uninterrupted or error-free. Under no circumstances will we be responsible for any direct, indirect, unforeseen, special, or consequential damages that are generated, either by the use or lack of capacity to use the Site, including damages that arise as a result of your reliance on the information obtained on the Site which causes mistakes, omissions, interruptions, deletion or corruption of files, viruses, operation or transmission delays, or any other type of glitch in its operation.

The publication or reservation of a property, whether by warranty, contract, distress (including negligence) or any other legal theory, and whether Propertymanagementgutierrezgroup.com.co has been informed of the possibility of such damages, even if it is determined that a limited compensation set out in these Terms and Conditions has failed in its essential purpose.
  5. The total responsibility of Propertymanagementgutierrezgroup.com.co for any claim or controversy that arises from these Terms and Conditions or in relation to them, your interaction with our employees, or the use or inability to use our services is limited by the current legislation. Therefore, the duration of claims established by law will be limited to the maximum extent allowed by our national legislation.

Compensation

  6. Failure to accurately report, collect or remit taxes.
  7. The breach of any law, regulation, or third-party rights such as intellectual property or privacy rights.

Intellectual Property Rights

GUTIERREZ GROUP is a registered trademark and, therefore, it is protected in all aspects in accordance with the provisions of Decision 486 of 2000 of the Andean Community of Nations (CAN) and other regulations that add to or modify it. Its unauthorized use constitutes a violation of national and foreign laws on industrial property. In this sense, you are not authorized to promote, market, sell in any way, nor execute or publicly announce that our brand is licensed and exploited directly or indirectly by third parties.

In accordance with the foregoing, all computer, graphic, advertising, photographic, and/or design material, as well as all content, texts and databases made available to you on the Site, on social networks, and/or on Printed advertising is our exclusive property or that of third parties who have authorized their use and/or exploitation.

Any act of copying, reproduction, modification, creation of derivative works, sale or distribution, exhibition of our properties is prohibited.

In no way do these Terms and Conditions give rights, licenses and/or authorizations to perform the acts described above. Any unauthorized use of the contents will constitute a violation of these terms and conditions and the current regulations on trademarks, copyrights and/or other applicable national and international intellectual property regulations and will trigger the corresponding civil and criminal actions.

CLAIMS

Claims must contain:

  • Your ID
  • Description of the facts that cause the claim
  • Address
  • Attached documents (if applicable)

If the person in charge of receiving the claim detects that the data is not complete, we will ask you, within five (5) days after receiving the claim, to make the necessary corrections. The person in charge of receiving the claim will respond to it. If they are not the right person to do so to do so, they will send it within a maximum period of two (2) business days to whom must answer and will inform you of such situation.

We will respond to the claim within five (5) business days from the day following its reception. If it is not possible to give you an answer within this period, we will inform you of the reasons for the delay and we will indicate the response date, within eight (8) business days following the first expiration date.

The claims presented must be registered in the National Registry of Databases.

VALIDITY

The Terms & Conditions come into effect on the date of their publication.
